Article 1:
Scope and modification of the general terms and conditions of sale
• These general terms and conditions of sale apply to all orders placed on the website www.morganerospars.com
• MORGANE ROSPARS reserves the right to adapt or modify these general terms and conditions of sale at any time. In the event of modification, the general terms and conditions of sale in effect on the date the order is placed will apply to each order.

Article 2:
Product availability
Online bookplates are available while supplies last, with a limit of 5 copies per design. You can find the number of bookplates still available on each product page. Upon receiving your order, we will check the availability of the product(s) ordered in case of an error in the count on the product page. If an item is unavailable, you will be asked to choose another from the online product list. If none of the options are suitable, your order will be fully refunded within one week.
The order validation date corresponds to:
• Acceptance of your order.
• In the event of stock shortage on one of the products in your order, we will ship the rest of your order, along with an information message.

Article 3:
Price
Prices are expressed in euros inclusive of VAT and exclude international shipping costs (free shipping within France). The user will be responsible for these international shipping costs unless they benefit from a special offer that waives them. MORGANE ROSPARS reserves the right to modify its prices at any time, particularly in the event of increased costs, changes in the VAT rate, or in the case of a manifest error, but undertakes to apply the prices in effect at the time of your order, subject to availability on that date.

Article 4:
Payment methods and security
• Payment methods: You can pay by credit card or PayPal. You do not need a PayPal account to make a payment.
• Security: Your credit card details are encrypted using the SSL 128 (Secure Socket Layer) protocol and are never transmitted unencrypted over the network. Payment is processed directly by the bank. MORGANE ROSPARS has no access to this data and does not store it on its servers. This is why you are asked to provide it again for each new transaction on our site.
• Retention of title clause: The products remain the property of MORGANE ROSPARS until full payment of the order. However, from the moment of delivery, the risks associated with the delivered goods are transferred to the customer.
• Default of payment: MORGANE ROSPARS reserves the right to refuse to make a delivery or to honor an order from a consumer who has not fully or partially paid for a previous order or with whom a payment dispute is being administered.

Article 5:
Delivery terms
MORGANE ROSPARS cannot be held responsible for any consequences resulting from a delivery delay by the Carrier. MORGANE ROSPARS may be relieved of all liability by proving that the non-performance or improper performance of the contract is attributable either to the consumer or to an unforeseeable and insurmountable event caused by a third party to the contract.

MORGANE ROSPARS creation timeframe
• For customizable collection models: 10 to 15 days ( or more depending on the period of activity).
• For special custom orders: 6 months (or more depending on the period of activity).

Customer validation deadlines
• For customizable collection models: 7 days
• For custom-made special orders: 7 days

Delivery times
• After you have approved the personalized or custom-made designs, delivery may take 10 to 15 business days for mainland France, Corsica, and Monaco, subject to product availability (in accordance with Article 2). Public holidays are not counted as business days.
• Delivery may vary from 5 to 30 working days for foreign countries, subject to stock availability (in accordance with article 2).
• This is an average delivery time depending on the destination, shipping method and item availability.

Delivery methods
• The ordered product is delivered by La Poste, to the address shown on the order form.
• Chronopost or DHL deliveries available upon request

Defects and delivery delays
• MORGANE ROSPARS cannot be held responsible for delays and other delivery errors caused by partner carriers.
• In the event of an error in the address details provided by the Buyer, MORGANE ROSPARS cannot be held responsible for the non-delivery of the order. Should the Buyer make an error, the cost of resending the order will be charged at the Buyer's expense. Delivery is marked as "Completed" when the package is handed over to the Buyer.

The condition of the package upon delivery
• If the Buyer notices a defect or has any doubt about the conformity of the package, they must check all of the contents in the presence of the carrier. In the event of the package being damaged or its contents being defective, the Buyer must issue written reservations, dated and signed by both parties: the Buyer and the carrier. Any claim against the carrier, if necessary, must be made within 10 business days of receiving the package. MORGANE ROSPARS cannot be held liable under any circumstances if the package arrives at its destination in poor condition.

Delivery in case of absence
• If the Buyer is absent when the carrier attempts delivery, the carrier will leave a delivery notice at the address provided when the order was placed. The Buyer must then collect their package from the address indicated by the carrier within the time frame specified on the delivery notice. If the Buyer exceeds this time frame, the package will be returned to MORGANE ROSPARS. The Buyer will be responsible for the return shipping costs.

Delivery costs
FRANCE: Free Colissimo shipping for all bookplate purchases. For other products, shipping costs are calculated based on weight and delivery options (Colissimo or tracked letter). INTERNATIONAL: Shipping costs €15 (varies depending on the destination).

Article 6:
Responsibilities
• MORGANE ROSPARS cannot be held responsible for the non-performance of the contract due to a case of force majeure, fortuitous event, disruption or total or partial strike in particular of postal services and means of transport and/or communications, flood, fire.
• The choice and purchase of a product are the sole responsibility of the customer. The total or partial inability to use the products, particularly due to hardware incompatibility, cannot give rise to any compensation, reimbursement, or liability on the part of MORGANE ROSPARS.
• In the event of non-delivery of an order or part of an order, you have a maximum of 30 days (from the date the order was placed) to notify us. After this period, no claim will be considered.

Article 7:
Right of withdrawal
Right of withdrawal
In accordance with Article L.121-20 of the French Consumer Code, the consumer has 14 days to exercise their right of withdrawal without having to provide any justification or pay any penalties, except, where applicable, for return shipping costs. However, this legal withdrawal period ends upon your acceptance of the order form. Validation of this order form initiates the personalization or creation process for your bookplate and therefore cannot be canceled due to the impossibility of selling the product to a third party. Regarding custom bookplates, if an initial design has been presented to the client, a refund is no longer possible given the work already begun.

Return procedure
• No returns are accepted after order confirmation (see paragraph above) except in the case of a problem with the quality of the product received or a delivery error. If you encounter this problem, please contact us via the contact form, indicating your order number and the nature of the problem. You can also attach a photo of the product showing the non-conformity.
• In the event of a non-conforming product, a similar replacement will be sent free of charge. If the customer refuses this exchange, they may return the order at their own expense. If the order includes a personalized product, no refund will be issued. If an exchange is impossible (due to stock shortage, for example), return shipping costs will be covered by MORGANE ROSPARS. Simply contact MORGANE ROSPARS to arrange for prepaid postage.
• This return policy applies only to complete products in their original condition (packaging, accessories, etc.) with a copy of the purchase invoice. Items returned incomplete, damaged, or soiled by the customer will not be accepted or exchanged.
• MORGANE ROSPARS undertakes to offer you an exchange, a credit note or a refund within a maximum of 30 days after we receive the products.
• No cash on delivery shipments will be accepted.

Article 8:
Intellectual property
All reproduction is prohibited. The designs on this site are registered with the INPI (French National Institute of Industrial Property) and may not be sold or used for any other purpose. Purchased designs may only be used for strictly personal purposes. Any professional or commercial use is prohibited.
The designs created by Morgane Rospars are the property of Morgane Rospars, and no other use will be permitted without prior authorization. The source files for the illustrations are neither available for sharing nor transfer.

• For limited edition models: the buyer is guaranteed that no model will be sold beyond the 10 planned copies, except for reproduction in case of loss or theft under the same name as the first purchase.
• For custom designs: the buyer is guaranteed that no reproduction of this original design will be made on any other bookplate or in any other form or medium. Upon receipt of payment, the buyer becomes the sole owner of this personalized stamp. However, they do not own the design itself and may not use it for any purpose other than personal use. See above.

Bookplates created by Morgane Rospars and bearing the owner's name, whether limited edition or custom-made, can be displayed online or in person. If the owner does not wish to have their name displayed, they simply need to indicate their preference at this address here .

Article 9 :
Guarantee
Without prejudice to the aforementioned right of withdrawal, the Buyer benefits from the warranty against hidden defects as provided for in Article 1641 of the French Civil Code. Furthermore, if the Product received by the Buyer does not conform to the Product specified in their Order, this Product will be replaced or refunded, according to the Buyer's preference.

Article 10:
Information technology and freedoms provisions
You have the right to access, modify, rectify, and delete your personal data at any time (Article 34 of the French Data Protection Act of 6 January 1978). MORGANE ROSPARS does not disclose your contact information to any third party.

The Buyer is informed that their data:
• are collected fairly and lawfully
• are collected for specific, explicit and legitimate purposes
• will not be further processed in a manner incompatible with these purposes
• are adequate, relevant and not excessive in relation to the purposes for which they are collected and their subsequent processing
• are accurate and complete
• are kept in a form which permits identification of the persons concerned for no longer than is necessary for the purposes for which they are collected and processed.

The Seller further undertakes to take all necessary precautions to preserve the security of the data, and in particular to prevent it from being distorted, damaged or accessed by unauthorized third parties.

This data is used to process the Order and to improve and personalize the services offered by the Seller. It is not intended to be shared with third parties.

The Buyer has the right to object to the processing of personal data concerning him/her and to the use of such data for prospecting purposes, including commercial prospecting.

The Buyer may ask the Seller for confirmation as to whether or not personal data concerning him/her is being processed, information relating to the purposes of the processing, the categories of personal data processed and the recipients or categories of recipients to whom the data is communicated, communication of the personal data concerning him/her as well as any available information as to the origin thereof.

The Buyer may also require the Seller to rectify, complete, update, block or erase any personal data concerning them that is inaccurate, incomplete, ambiguous, outdated, or whose collection, use, disclosure or storage is prohibited.

Applicable Law and Jurisdiction
All relationships arising from the connection to and/or use of this site are subject to French law.
The competent court in case of dispute will be the court of Paris.
